  Conditions of Entry
  

  The Competition is a game of chance and is authorised under the Permits.

  The material used to market and promote the Competition forms part of the Competition terms. If there is an inconsistency between the material used to market and promote the Competition and the Competition terms, the Competition terms prevail.

  Entry Restrictions	Open only to Australian residents who are aged 18 or over and are a valid current Flybuys member (or new Flybuys member who joins during the Competition Period) and a valid current Velocity Frequent Flyer member (or new Velocity Frequent Flyer member who joins during the Competition Period). To be a valid Flybuys member the Flybuys member account must include the member’s full name, a valid postal address, a valid email address and a valid contact phone number current at time of the Draw.  Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the other agencies or companies associated with the conduct or running of this competition are ineligible to enter.
  Competition Period	From 12.01am (AEST) on 01/09/2024 to 11.59pm (AEDT) on 31/10/2024.
  Entry Method	To receive an automatic entry (or entries) in the prize draw, Flybuys members must do one or more of the following actions between 12:01am (AEST) on 01/09/2024 and 11:59pm (AEDT) on 31/10/2024 (Competition Period): (a) Linking Flybuys account to Velocity Frequent Flyer account Receive 1 entry into the prize draw for linking your Flybuys account to your Velocity account for the first time. This entry mechanic is only available to members who have not previously linked their Flybuys and Velocity accounts. To receive an entry for linking your accounts, your Flybuys & Velocity accounts must remain linked until 11:59pm (AEDT) 31/10/2024 (b) Manual Transfer  Once your accounts are linked, receive 2 entries into the prize draw for every 1,000 Flybuys points you manually transfer from your Flybuys account to 500 Velocity points into your Velocity account. To receive an entry for manual transfer, for each eligible entry, your Flybuys & Velocity accounts must remain linked until 11:59pm (AEDT) 31/10/2024 (c) Auto Transfer Once your accounts are linked, opt-in to Auto Transfer (includes members who already have Auto Transfer turned on) and receive 3 entries into the prize draw for every 1,000 Flybuys points automatically transferred from your Flybuys account to 500 Velocity points into your Velocity account. To receive an entry for auto transfer, for each eligible entry, your accounts must remain linked and you must remain opted into Auto Transfer until 11:59pm (AEDT) 31/10/2024. The following additional terms apply when transferring points from your Flybuys account to your Velocity membership: If you’ve linked your Velocity Frequent Flyer membership to your Flybuys account, you can choose to manually transfer a minimum of 1,000 Flybuys points at a time to receive 500 Velocity Points per 1,000 Flybuys points transferred to Velocity. Or, you can turn on Auto Transfer and if you choose to do this, your entire existing Flybuys points balance (to the highest multiple of 1,000 Flybuys points) will be automatically transferred to your linked Velocity account, and every 1,000 Flybuys points you subsequently collect will be automatically transferred into 500 Velocity Points. There is no limit to the amount of Flybuys points you can transfer to Velocity. Only one Velocity membership can be linked to a Flybuys account at any one time. To turn on Auto Transfer, the full name and date of birth on your Flybuys account and linked Velocity membership must match. You can de-link or manage your linked accounts at any time at  https://experience.flybuys.com.au/partners/velocity-frequent-flyer/. Visit flybuys.com.au/transfer to manually transfer your Flybuys points. Alternatively, to turn on Auto Transfer, visit https://experience.flybuys.com.au/partners/velocity-frequent-flyer/ and sign in to your Flybuys account then turn your Auto Transfer preference to ‘On’. This selection will apply to all members under that specific Flybuys account. You can turn your Auto Transfer preference to ‘Off’ at any time and will still be able to manually transfer your Flybuys points to Velocity. Please allow up to 48 hours for Velocity Points to be credited to your linked Velocity account and for your Flybuys points balance to be updated. Once Flybuys points have been redeemed for Velocity Points they can’t be returned to your Flybuys account. Standard Flybuys Terms and Conditions apply to the collection of Flybuys points. Velocity membership Terms and Conditions apply once Flybuys points are transferred to Velocity.
  Entry Limits	You may enter as many times as you like provided the entry criteria detailed in Entry Method above are met.
  Prizes	Prize Pool There are 405 prizes to be won as follows: 1 x First Prize – prize consists of 5,000,000 Velocity Points (valued at $152,580) and 5,000,000 Flybuys Points (valued at up to $25,000); prize is valued at up to $177,580 (incl. GST). 4 x Second Prizes - each prize consists of 500,000 Velocity Points valued at $15,258 and 500,000 Flybuys Points valued at up to $2,500; each prize is valued at up to $17,758 (incl. GST). 400 x Third Prizes - each prize consists of 10,000 Velocity Points valued at $305.16 and 10,000 Flybuys Points valued at up to $50; each prize is valued at up to $355.16 (incl. GST). Total prizes: 405. Total prize pool value up to $390,676 (incl. GST). Prize Conditions 1. Velocity Point prizes are subject to terms detailed at https://experience.velocityfrequentflyer.com/member-support/terms-conditions 2. Flybuys bonus point prizes are subject to terms detailed at   www.flybuys.com.au/about/#/flybuys-terms-and-conditions Awarding Prizes Flybuys points will be automatically allocated to the Flybuys Account associated with the Winner’s Entry within 30 days of the respective draw date and Velocity Points will be credited to the Velocity Account associated with the Winner’s Entry within 30 days of the respective draw date.
  Winner determination for Flybuys household accounts	Only Flybuys members who are the named Flybuys primary account holder will be eligible to win a prize.  Individuals whose Flybuys membership card is linked to another Flybuys account as a ‘household member’ are eligible to enter this competition, however if their entry is drawn as the winning entry, then the prize will be awarded to the individual who is the named Flybuys primary account holder, and not the individual who holds the linked account.
  Draw Details	The draw will occur at 10.00am (AEDT) on 08/11/2024 at Focal Promotions, 2/7 Stayner Street Beaumaris VIC 3193. The first valid entry randomly drawn from all valid entries received during the Competition Period will win the First Prize, the next 4 valid entries randomly drawn will each win a Second Prize and the next 400 valid entries randomly drawn will each win a Third Prize. The awarding of prizes is restricted to one prize per entrant except for SA residents. The Promoter may request that winners provide proof of identity, proof of age and proof of residency to the Promoter’s reasonable satisfaction before awarding the prize. If a winner does not provide proof of identity, proof of age or proof of residency to the Promoter’s reasonable satisfaction within 90 days after being selected as a winner, the Promoter may redraw the prize in accordance with the Unclaimed Prize Draw details.
  Winner Notification and Publication	The winners will be notified in writing (or via email) within 7 days after each draw date and the winners’ names and postcode will be posted on the Flybuys website within 7 days after each draw date for a period of 28 days. If there is no prize winner or the prize winner cannot be found the Promoter will publish that information on their website at www.flybuys.com.au.
  Unclaimed Prize Draw Details	10am (AEDT) on 10/02/2025 at the same location as the original draw.
  Unclaimed Prize Draw Winner Notification and Publication	Any winners in the Unclaimed Prize Draw will be notified in writing (or via email) within 7 days after the draw date and the winners’ names and postcode will be posted on the Flybuys website within 7 days after the draw date for a period of 28 days.

  1. Information regarding prizes and how to enter forms part of these conditions. The entrant may be automatically entered into the competition if the Entry Method criteria has been met. By entering into this competition entrants agree to these terms and conditions. A winner agrees to these terms and conditions by accepting a prize.
  2. Entries must be received during the Competition Period.  Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise.  The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.  Entrants who enter using multiple aliases may be disqualified. Consumers are responsible for their own costs associated with accessing the Internet. Automatically generated entries may be disqualified. 
  3. The Promoter may communicate or advertise this competition using Instagram, Facebook and other social media platforms. However, the competition is in no way sponsored, endorsed or administered by, or associated with those social media platforms. Entrants are providing their information to the Promoter and any other third parties as outlined in clause 19, and not to the social media platforms. Each entrant completely releases Instagram, Facebook and all other social media platforms from any and all liability.
  4. The Promoter is not liable for late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, correspondence or claims for prizes due to error, omission, tampering, theft, destruction or otherwise.
  5. If an entrant’s contact details change or they do not wish to participate in the competition, the entrant must notify the Promoter by calling the Flybuys service centre (13 11 16).
  6. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person (including without limitation an entrant (or any companions, including a winner) who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate. An entrant is fully responsible for the acts and omissions of any companion/s, including a winner, and the Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, the entrant and any of their companions (including a winner) if the entrant or any of their companions breaches these conditions, whether or not legally bound by them. The Promoter’s decision is final and no correspondence will be entered into.
  7. The draws will be conducted at the times, on the dates and at the location as stated in the Draw Details.
  8. The Promoter may require the winners to provide proof of identity, age, residency, winning social media profile, email address associated with their Flybuys account and Flybuys membership number. Identification considered suitable for verification is at the Promoter’s discretion.
  9. If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with the Unclaimed Prize Draw Details.
  10. Any prize is as stated in the Prize Details. Flybuys bonus points are not transferable or exchangeable and cannot be redeemed for cash.  The Promoter accepts no responsibility for any variation in points value. Flybuys bonus points are subject to terms detailed at   www.flybuys.com.au/about/#/flybuys-terms-and-conditions. Use of Velocity Points is subject to the Velocity Members Terms and Conditions, which are located on the Velocity Frequent Flyer website at: https://www.velocityfrequentflyer.com/content/TermsConditions/.
  11. The winners will be notified in accordance with the Winner Notification and Publication section of these conditions. By entering this competition, each entrant requests that their full address not be published.  The winners (and any companions) must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their names and images in promotional material. Where winners are automatically entered into this competition the Promoter will contact them for their written consent prior to publishing their names or images for promotional activity in accordance with this clause.
  12. Any disputes concerning this competition will be resolved privately between the disputing party and the Promoter. 
  13. Prizes are not transferable or exchangeable and (except where cash is specified) cannot be redeemed for cash.  If for any reason a winner (or their companion) does not take an element of a prize at the time stipulated by the Promoter then that element of the prize will be forfeited and cash will not be supplied instead. The Promoter accepts no responsibility for any variation in prize value. If a prize or any element of a prize is unavailable for any reason, the Promoter may substitute for that prize or element of that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant gaming authorities if required.
  14. If for whatever reason, a prize cannot be allocated in accordance with the ‘Prizes’ section of these conditions of entry, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws in accordance with the Unclaimed Prize Draw Details as are necessary to distribute the relevant prize, subject to any requirements of the relevant gaming authorities.  Any winner(s) in this draw will be notified as stated in the Unclaimed Prize Draw Winner Notification and Publication.
  15. Entrants and Winners rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the extent that it is permitted to do so, the Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including, without limitation, allergies, skin conditions or other reactions), illness or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).  Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010.
  16. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to prizes. Prizes will be delivered in Australia only.
  17. If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant  gaming authorities if required.
  18. The Promoter is not liable for any tax implications arising from prize winnings.  Independent financial advice should be sought.  Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
  19. The Promoter collects personal information about entrants and winners in order to run the Competition, including awarding the prize and disclosure to third parties, including Velocity Frequent Flyer Pty Ltd, the Promotor’s agents or third-party service providers, for the purpose of conducting the Competition, or for promotional and marketing purposes. By entering into the Competition, the entrant warrants that they have obtained the winner’s consent to provide the Promoter with the winner’s personal information. The Promoter uses and manages entrants’ and winners’ personal information in accordance with its privacy policy which is available at https://www.flybuys.com.au/about/#/privacy-policy. By entering the Competition, each entrant consents to the Promoter using their personal information for future marketing and promotional purposes.

  Reward Seat fares are subject to availability, and seats are limited and may not be available at peak times or on all flights. Redemption bookings must be booked on the Velocity website and selecting 'use Points'. Taxes, fees and carrier charges are payable at the time of booking and will vary depending on carrier, city pair, fare class date and time of booking. Payment surcharge may apply. You can change or get a refund for your booking by paying a fee and any fare difference, at least 24 hours before scheduled departure.
